Terms of Service

Effective 17 September 2026 · Version 1.0

Draft pending legal review. This document describes how Mentara Persona actually operates and is written to be accurate, but it has not been reviewed by a qualified attorney. Have counsel review it before relying on it commercially — particularly Sections 6 and 7.

These Terms govern your use of Mentara Persona (the “Service”), software that runs a real-time conversational voice persona on your computer. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using it you represent that you are 18 or older and that you have the legal capacity to enter into these Terms.

2. What the Service does

The Service captures audio from an audio device you select, converts speech to text, generates a response using one or more third-party language models, synthesises that response as speech, and plays it back through an audio device you select. It records technical measurements about each exchange (timing, confidence scores, turn-taking decisions) so the Service can be operated, debugged and improved.

The persona is software. It is not a person, it does not have feelings or memories of you beyond what the Service stores, and nothing it says is advice of any kind.

3. Your account

You are responsible for your account credentials and for everything that happens under your account. Do not share your account. Tell us promptly if you believe it has been compromised.

4. Credits and billing

5. Acceptable use

You may not use the Service to:

We may suspend or terminate accounts for violations, without refund where the violation is serious.

6. Conversations involving other people

This section is important, and it is your responsibility rather than ours.

If you use the Service in a conversation that includes anyone other than you — a call, a voice channel, a stream, a recording — you are solely responsible for obtaining any consent required by law from those people, and for complying with all applicable recording, wiretap and privacy laws in your jurisdiction and theirs. Some jurisdictions require the consent of every party to a conversation before it may be recorded or processed.

You agree that:

We cannot obtain consent on your behalf and we do not attempt to. Do not use the Service with people who have not agreed to it.

7. Data, and the licence you grant us

Our Privacy Policy explains what we collect and why, and forms part of these Terms.

7.1 Licence

You grant Mentara a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable and transferable licence to host, store, reproduce, modify, analyse, and create derivative works from content and data generated through your use of the Service, for the purposes of:

7.2 Derived datasets

We create datasets from measurements of how conversations proceed — timing, latency, speech-recognition confidence, interruption and turn-taking behaviour, whether and when the persona chose to respond, and similar technical signals. These datasets are de-identified and may be distributed or licensed to third parties.

We do not sell, licence or distribute audio recordings, voiceprints, speaker embeddings, or any material designed to identify a person by their voice. We do not perform speaker identification.

7.3 Your rights

You retain ownership of what you say. The licence above is what allows us to run and improve the Service and to produce derived datasets; it is not a transfer of ownership. You may request deletion as described in the Privacy Policy. Deletion applies going forward and does not require us to retrain models already trained, or to recall datasets already distributed.

8. Third-party services

The Service sends audio, text and technical data to third-party providers in order to function — speech recognition, language models, speech synthesis, authentication and payments. Those providers process data under their own terms. They are listed in the Privacy Policy.

9. Early software; no warranty

The Service is provided “as is” and “as available”. It is early software. It will have defects, it will be interrupted, and its output will sometimes be wrong, inappropriate, or nonsensical. To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

You are responsible for what the Service says on your behalf and for any consequence of using it in a conversation with other people.

10. Limitation of liability

To the maximum extent permitted by law, Mentara will not be liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits, data or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.

Some jurisdictions do not allow these limitations; in those places they apply to the fullest extent permitted.

11. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if continuing to provide the Service to you would create legal or safety risk. Sections 7, 9, 10 and 12 survive termination.

12. Changes to these Terms

We may update these Terms. If a change materially reduces your rights or expands the licence in Section 7, we will give notice before it takes effect and, where required, ask you to accept the new version. Continued use after a change takes effect means you accept it. Each version is recorded with a version number and effective date so it is clear which version applied when.
